MyDigi Rewards™ Terms and Conditions

General
1. The MyDigi Rewards program is organised by Digi Telecommunications Sdn Bhd (Company No. 201283-M) ("Digi") and governed by these terms and conditions and all applicable terms and conditions including but not limited to Digi's Privacy Statement, Data Protection Statement and Data Protection Obligations found on Digi's website at www.digi.com.my (collectively referred to as the "Terms").
2. This rewards program is available in the latest version of the MyDigi applications.
3. The definition of "Participants" shall have the different meanings ascribed to it depending on the sections below.
4. In order to participate in this rewards program, the Participants must:-
a. install MyDigi applications into their mobile devices; and
b. subscribe to Digi's Services and such subscription must be active and valid at all times, specifically, where applicable, the Participant's Prepaid line should be in active status, or the Participant's Postpaid line should not have any bill in overdue status.
5. By using the MyDigi application, Participants will automatically be a member of the MyDigi Rewards program operated by Digi.
6. Each Participant agrees that s/he has read and understood the Terms and by his or her participation in and proceeding with this rewards program, each Participant:-
a. agrees to be bound by the Terms; and
b. if the Participant is below eighteen (18) years of age, also confirms that s/he has obtained prior consent from his or her respective parents or legal guardian to participate in this rewards program. In the event the Participant fails to provide Digi with the said parental / guardian consent upon request by Digi, such individual shall be subject to Clause 11.a below.
7. By participating in this rewards program, each Participant agrees and consents to such details including without limitation personal data/information being collected, processed and used by Digi for:-
a. the purpose of this rewards program; and
b. marketing and promotional activities conducted in such manner as Digi sees fit worldwide in any media including without limitation the Internet, without further express consent from, or payment or consideration to the relevant Participants. Marketing and promotion activities includes without limitation the use and/or publication of any details provided in and/or in connection to the entries, interviews material as well responses and related photographs. In this regard, each Participant agrees to co-operate and participate without further express consent and/or payment or consideration, in all reasonable advertising and publicity activities of Digi relating to this rewards program; and
c. other promotional, marketing and publicity notification/information including future promotional, marketing and publicity notification/information from Digi from time to time.
8. In addition, where any of the data/information especially personal data relating to the Participant and/or third parties (where applicable) is submitted to Digi and/or by any entrant in connection to this rewards program, each:-
a. warrants that s/he is in possession of all necessary consents and shall continue to maintain such consents as may be required for Digi and/or usage and processing of such data/information; and
b. agrees that it shall be his or her responsibility to advise Digi in writing should there be any relevant change in the data/information provided to Digi which requires action on the part of Digi.
9. Each Participant hereby agrees and irrevocably and unconditionally undertakes to indemnify Digi (on full indemnity basis) against any claim by any third party and against any loss, damage, cost or expense (including solicitors' fees and cost) that it may suffer or incur as a result of or in connection with this rewards program and the rewards.
10. Each Participant further agrees:-
a. to release and hold harmless Digi against any and/or all losses, damages, rights, claims and actions of any kind in connection with this rewards program (including resulting from acceptance, possession, use or misuse of any rewards, or travel to or from any reward-related activity and claims based defamation, or invasion of privacy);
b. that Digi makes no warranties, express or implied, in fact or in law, relative to the use or enjoyment of any of the rewards, including, without limitation to, their quality, merchantability or fitness for a particular purpose;
c. that Digi shall not be liable for any losses, damages, rights, claims and actions of any kind (including without limitation loss of damage to property or any personal injury or loss of life, loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties) howsoever arising whether in contract, tort, negligence or otherwise, in connection with this rewards program, and/or the rewards, even if Digi has been advised of the possibility of such damages in advance, whether or not due to and/or arising from:-
i. telephone, electronic, hardware or software program, network, Internet, server or computer malfunctions, failures, interruptions, miscommunications or difficulties of any kind, whether human, mechanical or electrical, including, without limitation to, the incorrect or inaccurate capture of entry information online;
ii. late, lost, delayed, misdirected, incomplete, illegible or unintelligible e-mails;
iii. virus attacks and/or any other malicious software infection to the Customers' mobile phones arising from the downloading of these contents, any failed, incomplete, lost, garbled, jumbled, interrupted, unavailable or delayed electronic transmissions;
iv. any condition caused by events beyond the control of Digi including those due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of Digi;
v. any printing or typographical errors in any materials associated with this rewards program; and
vi. any claims by third party for infringement of intellectual property rights.
11. Digi:-
a. reserves the right, at any time, to verify the validity and/or reject any entries at its sole and absolute discretion without having to assign any reasons whatsoever. Incomplete, indecipherable, illegible or incorrect, ineligible, fraudulent, unlawful or deceitful entries or any entry which violates the Terms, will automatically be disqualified;
b. reserves the right to disqualify a Participant if s/he is found to be ineligible at any point of time and to cancel/withdraw/recall the reward. If such Participant has enjoyed the reward, such Participant hereby agrees and undertakes to indemnify Digi for the cost of the reward, failing which, Digi shall have the right to initiate any action it deems necessary against such Participant;
c. reserves the right to cancel, suspend or terminate any Participant's membership in the MyDigi Rewards program without having to assign any reason and without any prior notice;
d. reserves the right to reject any entries and/or withhold the reward or forfeit the reward where Digi believes that there are unlawful, deceitful and/or fraudulent acts and practices without any prior notice;
e. reserves the right, at any time, to vary, delete or add to any of the mechanics, the reward or the Terms, and alter, cancel, terminate or suspend this rewards program and/or any part thereof without any prior notice
f. for the avoidance of doubt, cancellation, termination or suspension by Digi of any entry or this rewards program shall not entitle the Participants to any claim or compensation against Digi for any and all loss or damage suffered or incurred by the Participants as a direct or indirect result of the act of cancellation, termination or suspension
g. shall not be responsible or liable for any claims of loss or damage to property or any personal injury or loss of life resulting from or in connection with this rewards program;
h. shall not be liable for any loss or damage (including without limitation loss of income, profits or goodwill, direct or indirect, incidental, consequential, exemplary, punitive or special damages of any party including third parties howsoever arising whether in contract, tort, negligence or otherwise, in connection with this rewards program, even if Digi has been advised of the possibility of such damages in advance, and all such damages are expressly excluded; and
i. shall not be liable for any default due to any act of God, war, riot, strike, lockout, industrial action, fire, flood, drought, storm or any event beyond the reasonable control of Digi.
12. All decisions by Digi, including but not limited to the selection of Participants and the rewards as well as forfeiture of the rewards are final, conclusive and binding. No correspondence or claims shall be entertained.
13. A failure by Digi to enforce any of the Terms in any instance(s) will not give rise to any claim by any person.
14. All other terms and conditions governing the use of any of Digi's mobile telecommunication services shall apply herein mutatis mutandis.
15. The Terms shall be governed and construed by the laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Courts of Malaysia.
 
Digi Points
1. Digi Points are used to calculate the Participant's progress to subsequent membership tiers and their corresponding access to the benefits specific to each of those tiers
2. Digi Points are awarded to Participants based on the following transactions performed by the Participant, on the following basis:
a. One (1) Digi Point for every RM1.00 reloaded into a Participant's Prepaid line; or
b. One (1) Digi Point for every RM1.00 Postpaid bill charge, excluding refundable deposits, device purchases.
3. Digi may, at its sole and absolute discretion, increase or decrease the rate of Digi Points to be awarded for each eligible transaction, as well as revising the specific eligible transactions to earn Digi Points. Digi also reserves the right to withhold any explanation pertaining to the calculation methods for awarding of Digi Points or any other matter relating to Digi Points
4. Digi Points may not be used in exchange for any rewards or benefits unless otherwise specified by Digi.
5. There shall be no extension of time for the validity period of Digi Points. Digi reserves the right to deal with expired Digi Points in such manner as it deems fit in its absolute discretion. Participants shall have no claim whatsoever against Digi for any expired Digi Points.
6. Digi Points have no cash or monetary value and are not redeemable for cash in any form. They cannot be purchased, resold or transferred, for value or otherwise, under any circumstances. Digi Points shall not be regarded, construed, or used as valuable or exchangeable instruments under any circumstances.
 
MyDigi Rewards Membership Tiers
1. The MyDigi Rewards program offers three (3) membership tiers ("tiers"): Yellow, Gold and Platinum.
2. MyDigi Rewards membership tiers are open to all Digi Prepaid and Postpaid Customers except:
a. enterprise customers under Digi Postpaid for Business; and
b. permanent, contract and temporary employees of Digi.
3. Participants are required to accumulate the below required Digi Points over a specified 6-month period in order to qualify for an upgrade or renewal of the tier:
a. Yellow: No minimum Digi Points requirement. This is the entry-level tier.
b. Gold: Minimum 300 Digi Points.
c. Platinum: Minimum 1,500 Digi Points.
4. Membership tiers are awarded according to the following earning cycle of Digi Points:
a. Digi Points earned between 1 January and 30 June qualify towards the Participant's applicable tier for the period of 1 July to 31 December of the same year
b. Digi Points earned between 1 July and 31 December qualify towards the Participant's applicable tier for the period of 1 January to 30 June of the subsequent year.
5. Membership tier upgrades will be awarded upon achieving the required Digi Points, within but not restricted to, forty eight (48) hours of the Participant performing a qualifying Prepaid Reload, or readiness of the Participant's Postpaid bill.
6. Membership tier reviews for renewal or downgrade of tiers take place on 1 January and 1 July
7. Digi reserves the sole and absolute discretion to revise the definition of membership tiers, including but not limited to the number of qualifying required to achieve or renew a tier, the number of tiers available and benefits accompanying each membership tier, without any prior notice to Participants.
 
Rewards
1. All rewards, whether paid or free, offered on the MyDigi Rewards program are a collaborative effort between Digi and various rewards partners ("Partners").
2. As a member of the MyDigi Rewards program, Participants will have access to rewards and promotions offered in the form of e-vouchers via the MyDigi app, as well as other benefits offered by Digi and/or their third-party merchant partners.
3. Rewards are open to all Digi Prepaid and Postpaid Customers ("Participants"), except enterprise customers under Digi Postpaid for Business.
4. Details as well as the terms and conditions of the offers and/or products (collectively, "Rewards") can be found at the respective Reward Details pages on the MyDigi app. All pricings for the Deals are exclusive of the Sales and Services Tax (SST).
5. The availability of any Reward is based on availability of stock and granted on a first-come-first-served basis. Rewards may vary varied monthly.
6. A Reward's availability and its terms and conditions may vary from time to time, at Digi's discretion.
7. Rewards may have maximum purchase or download restrictions within any specified period of time, which Digi reserves the right to update or amend at any time.
8. Upon a successful Reward purchase or download, the Reward will be stored in the Participant's MyRewards section, until expiry of such Reward.
9. By purchasing any Rewards, the Participant acknowledges and agrees that all Rewards will further be governed by the respective Partners' terms and conditions whereby Digi shall not have any liability whatsoever in respect of the Rewards, including usage or restrictions on usage of the Rewards.
10. The Participant shall utilise any purchased Reward(s) within the validity period stated in the "Reward Details" page in the MyDigi app, failing which the purchased Reward(s) shall be forfeited automatically and without prior notice.
11. Digi is not required to provide any notice of expiry of Rewards to the Participant.
12. Rewards are not exchangeable for cash, nor exchangeable for other Rewards under any circumstances. Rewards should not be sold, exchanged or transferred for value under any circumstances.
13. By utilising any Reward, each Participant agrees and irrevocably and unconditionally undertakes to fully absolve Digi of all liabilities and agrees to indemnify Digi (on full indemnity basis) and hold Digi harmless against any claim by any third party (inclusive of the Partners) and against any loss, damage, cost or expense (including solicitors' fees and cost) that Digi may suffer or incur as a result of or in connection with the Participant' use of any Deals.
14. Digi reserves the sole and absolute right to cease, alter, cancel, suspend or substitute the Partners and/or Deals at any time without prior notice. For the avoidance of doubt, such cessation, alteration, cancellation, suspension or substitution by Digi does not entitle the Participant to any claim or compensation against Digi (in cash or in kind) for any and all loss or damage suffered or incurred by the Participant as a direct or indirect result of the act of cessation, alteration, cancellation, suspension or substitution.
